1. Purpose of politics

The purpose of this privacy policy is to make you aware of how Bent Nygaard Elektronik ApS, CVR.nr. 14705589, (hereinafter “we”, “us”, “our”) processes your personal data in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act (DBL).

2. The short version

We process your personal data for one or more specific purposes, including when you are a business customer with us, in connection with customer inquiries, are a supplier or business partner, receive our marketing, visit our website, use our contact form, visit our social media pages, apply for a job with us or are the next of kin of one of our employees.

The information will predominantly come directly from you, and we will only process your information for as long as is necessary for the purpose for which it was collected. However, the information may also be processed and stored for longer in anonymized form.

Below you can get an overview of the different types of processing’s that we perform.

 

3.1 Business customers

In connection with the sale of our products, services and software, including “ Codesoft ” and “Nicelabel”, we process your personal data as a contact person. This information includes contact information such as name, company name, job title, address, email and telephone number, payment information and purchase history.

We process your information in connection with the sale of our products, services and software in order to enter into and fulfill an agreement with you as a business customer, cf. GDPR Article 6, paragraph 1, letter b.

Contact information is stored as long as we have a customer relationship, and for 5 years after the customer relationship ends. Accounting material is deleted on an ongoing basis, but no later than 5 years from the end of the financial year to which the material relates, cf. Section 12, subsection 1 of the Danish Accounting Act.

3.2 Customer inquiries

We also process your personal data if you contact our customer service with questions about your order or purchased products. The information we process will typically include the name of the contact person, company name, email, telephone number, address and information related to the inquiry.

We process your personal data based on our interest in being able to contact you and respond to your inquiries, cf. GDPR Article 6, paragraph 1, letter f.

We delete the information on an ongoing basis, but no later than 6 months after your last inquiry or until the customer inquiry has been handled.

3.3 Suppliers and partners

When we enter into agreements with suppliers and business partners, we process information about you as the contact person at the supplier or business partner. This includes information about the contact person’s name, company name, job title, telephone number, email and, if necessary, bank and payment information.

The information is processed because it is necessary for the fulfillment of the agreement with the supplier or business partner in question, cf. GDPR Article 6, paragraph 1, letter b.

We retain relevant contact information throughout our collaboration. Written correspondence is deleted on an ongoing basis, and information necessary to fulfill our obligations under the Danish Accounting Act is retained for 5 years from the end of the financial year to which the material relates.

3.4 Marketing

We only process your personal data for marketing purposes if you have given your consent in accordance with GDPR Article 6(1)(a) to, for example, receive newsletters about events, invitations, new products and offers . The scope of our processing is stated in the specific consent.

If you have consented to receive marketing from us, we will generally process information about your name, company name and email.

You have the right to withdraw your consent at any time by using the “unsubscribe” link in the newsletters you receive and by sending an e-mail to info@bnyelektronik.dk or calling tel. no. +45 75 79 04 00 .

We retain documentation of your consent for as long as you receive marketing or participate in our marketing and for 2 years after you have revoked your consent, as our possible criminal liability becomes time-barred after this period.

3.5 Website and cookies

3.5.1 Cookies

In connection with the general operation of our website, we collect personal information about you via cookies to improve the website’s performance and user experience, as well as to compile statistics. The information we collect via cookies includes your IP address, browser type, device (type, version, operating system, etc.) and user behavior, including page views.

We only collect your information if you have given your consent, cf. GDPR Article 6, paragraph 1, letter a. You can withdraw your consent at any time. Read more about this in our cookie and privacy policy here.

3.5.2 Contact form

You have the opportunity to contact us via our contact form via our website. In this connection, we also process your personal data. The information that we process is the name of the contact person, company name, email, telephone number and free text. It is also possible to write in a free text field, but we advise against writing personal data in this field unless it is relevant to the inquiry. The legal basis for this processing is GDPR Article 6, paragraph 1, letter f.

The information we process via our contact form is deleted on an ongoing basis and no later than 6 months after the last contact or until the inquiry has been handled.

3.5.3 Integrated plugins

On our website we also have integrated plugins from social media, through which they have the possibility of collecting data about you, if you have given your consent to this, cf. GDPR Article 6, paragraph 1, letter a. In this connection, we have a joint data responsibility with each media. We use integrated plugins from LinkedIn, Google and Youtube .

3.6 Tracking tools

3.6.1 Google LLC.

In addition to analysis tools from Meta Platforms, Inc., we also use analysis tools from Google LLC. in the form of Google Analytics.

Therefore, in connection with your visit to our website, we will process information about i) identification in the form of user ID and device ID and ii) dimensions, which include IP address, age, city, country, gender, interest, language and region. In addition, iii) activity, i.e. pages, clicks, downloads and forms, and iv) device information in the form of browser, OS, device (iPhone), screen reader engagement, time on page, scrolling and videos.

3.6.2 Analysis tools in newsletters

We use analysis tools in connection with sending out newsletters. We use, among other things, these so-called analysis pixels to record your online behavior in order to analyze which articles you clicked on, in order to optimize the organization and sending out of our newsletters.

We store the information as long as you receive marketing in the form of newsletters.

3.7 Social media

We use certain social media, including LinkedIn and YouTube, to connect with our customers and potential customers, and to promote our marketing. If you have visited and “liked” our fan page on social media or have been in contact with us through this, we inevitably process your personal data. We only process information about your name and email for this purpose.

If you contact us via social media, we process your personal data based on our interest in being able to contact you and respond to your inquiries, cf. GDPR Article 6, paragraph 1, letter f. The information will originate from you and the social media through which you contact us.

We have a so-called joint data controllership with the social media we use, as we both process your personal data for our own purposes. You can read more about the social media’s processing of your personal data below:

Information processed in connection with social media, which concerns direct communication via social media, is deleted immediately. Posts on e.g. Facebook pages or in other public groups are not deleted, as a post or comment in public groups is considered to be public areas. You can read more about public areas here .

3.8 Job application

If you apply for a job with us, we process your personal data in order to assess whether you are qualified for an existing or future position with us. We process the information you provide to us, including name, telephone number, email, address, date of birth, photo, application, CV, work and educational background and references.

We process your information in order to enter into an employment agreement with you based on your request for our processing of the application, cf. GDPR Article 6, paragraph 1, letterf. We also process information in cases where we assess that our interests in processing your personal data exceed your interests in not processing them, e.g. information collected from social media published by you, cf. GDPR Article 6, paragraph 1, letterf.

We share your personal information with the employees involved in the recruitment process and any recruitment company.

If you are not offered the position, we may retain your personal data for up to 3 years after the end of the recruitment period. If we wish to retain your data beyond the recruitment period, we will obtain your consent. The retention period will be stated in the relevant consent form.

3.9 Next of kin

We collect information about our employees’ closest contacts so that we can communicate with relevant relatives in the event of an emergency involving one of our employees.

We process your personal data on the basis of our legitimate interest in being able to inform you about the employee’s emergency situation so that you have the opportunity to act, cf. GDPR Article 6, paragraph 1, letterf.

We retain information about next of kin for as long as employment lasts. The information is deleted when employment ends. You or the relevant employee can always contact us to have the information deleted by sending an email info@bnyelektronik.dk .

4. Notification of legal or required processing

In cases where we process your personal data on the basis of a legal obligation or a requirement under a contract or a requirement that must be met in order to enter into a contract, you are obliged to provide us with the information so that we can maintain the customer relationship, fulfill the contract and invoice you for our services, etc. If you do not wish to provide us with the information that we need to comply with our obligations, the consequence may be that we are unable to establish or continue the client relationship or fulfill a contract with you.

You are not obliged to provide us with your information in other cases, e.g. for our marketing and newsletter purposes. However, the consequence of not providing us with your information will be that you will not be able to receive marketing material and newsletters from us, for example.

5. Recipients of personal data

We treat your personal data confidentially and do not generally disclose the information to third parties. However, we may disclose your personal data if you have given your consent, if we have a legitimate interest in the disclosure or if we have a legal obligation.

We may entrust personal data to our system suppliers who process personal data on our behalf and according to our specific instructions in accordance with the concluded data processing agreement.

In some cases, we use data processors outside the EU/EEA, whereby personal data may be transferred to third countries, including in connection with our use of cloud solutions. For this, we use a valid transfer basis in the form of either the EU-US Data Privacy Framework or the Standard Contractual Clauses before we transfer the personal data. If we use Standard Contractual Clauses, an individual assessment is always made regarding the need for supplementary measures. 6. Your rights

When we collect information about you, you have a number of fundamental rights under the personal data regulations that you can exercise. You can read more about your rights on the Danish Data Protection Agency’s website here .

The above-mentioned rights may be subject to conditions and limitations. Whether you as a data subject can request, for example, to have your personal data deleted will in all cases depend on a specific assessment.

If you have given your consent to our processing of your information, you have the right to withdraw this consent at any time.
